From the War on Terror to the War on Opioids

Ron cut his teeth in Federal Investigations during the Global War on Terror for the United States Marine Corps. As a Marine Corps Officer and Lawyer, he conducted high-level federal gun, drug, and terrorism investigations. He returned home and applied his skills to the defense of healthcare providers facing federal investigations, prosecutions, and False Claims Act cases. For the last decade, Ron has racked up a list of trial acquittals, dismissals, and non-prosecutions that lead the nation.

Unmatched Trial Results and Acquittals in High Profile Cases

He achieved an acquittal in a $550 million healthcare fraud and 56 count drug trafficking and healthcare fraud indictment against five physicians who were accused of distributing 13 Million doses of Oxycodone. That same year he acquitted Dr. Lesly Pompy a former Cleveland Clinic Physician accused of over $12 million in healthcare fraud and unlawful prescribing. Shortly after he achieved the dismissal of Dr. Thomas Sachy who was accused in a Federal Indictment in Georgia of killing two patients by prescribing Oxycodone. In addition, he acquitted two Kentucky physicians in separate trials against the Department of Justice’s Appalachian Regional Prescription Opioid Task Force (ARPO). Both physicians were separately charged with unlawful prescribing and healthcare fraud. Both were fully acquitted and will return to practice.

Ron’s experience in healthcare fraud and white-collar cases has been sought nationwide. He has achieved trial victories across the United States. He has been admitted into many federal district courts and routinely gains admission into district courts by permission of the Court. Ron has achieved acquittals and successful results across the country:

  • United States Supreme Court: Ron represented two defendants before the United States Supreme Court resulting in vacated convictions.

  • Federal Appellate Courts: Ron has represented clients before many United States Courts of Appeals including the 6th Circuit, 9th Circuit, 5th Circuit, and 11th Circuit.

  • United States District Courts: Ron has achieved a record number of trial acquittals for clients accused of health care fraud, drug trafficking, money laundering, wire fraud, and mail fraud including other white-collar offenses.

  • United States v. Kousa (Kentucky 2023): Acquittal of drug trafficking and healthcare fraud charges.

  • United States v. Sachy (Georgia 2023): Mid-trial Judicial dismissal of distribution causing death counts pursuant to Rule 29 of the Federal Rules of Criminal Procedure.

  • United States v. Reyes (Puerto Rico 2023): Pre-trial dismissal of emergency physician of over $5million in healthcare fraud allegations. Federal prosecutors in Puerto Rico alleged that he defrauded medicare and medicaid by double billing.

  • Naum v. United States (SCOTUS): The Supreme Court reversed and vacated a conviction for a West Virginia Suboxone physician convicted of unlawfully prescribing Suboxone.

  • United States v. Bothra (Michigan 2022 ): Acquittal of $550 million healthcare fraud and drug trafficking indictment.

  • United States v. Pompy (Michigan 2022): Acquittal of a $ 6 million healthcare fraud and drug trafficking indictment against an interventional pain physician.

  • People v. Oesterling (Michigan 2019): Acquittal of over 30 drug trafficking counts after a 1 month trial for a Johns Hopkins urologist. Later, in a separate case, Ron secured the release of over $6million in funds seized.

  • United States v. Aggarwal (West Virginia 2019): Acquittal of a West Virginia Suboxone physician

  • United States v. Chalifoux (West Virginia 2018): Pre-trial dismissal of 32 counts of healthcare fraud and drug trafficking against a Northern West Virginia (Wheeling) pain management doctor and Suboxone doctor.

  • United States v. McCutchen (Michigan 2017): Acquittal of drug conspiracy for an Ann Arbor Michigan physician charged with drug trafficking and conspiracy.

  • People v. Quigley (Michigan 2017): Pre-trial dismissal of a physician charged with unlawfully distributing hydrocodone.
